Agreement to Terms

These Terms of Service ("Terms") govern your use of the Qina mobile application ("App") operated by Qina ("us," "we," or "our"). By accessing or using our App, you agree to be bound by these Terms.

If you disagree with any part of these terms, then you may not access the App.

Description of Service

Qina is an interactive AI character chat application that provides users with the ability to:

Engage in conversations with AI-powered characters
Experience an interactive story called "Love Latte"
Unlock new content through character interactions
Customize their chat experience with various themes and settings
Submit feedback and suggestions

User Accounts and Eligibility

Age Requirements

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are 18 years of age or older.

Account Information

You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.

Prohibited Uses

You may not use our App:

For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false or misleading information
To upload or transmit viruses or any other type of malicious code

Content and Intellectual Property

Our Content

The App and its original content, features, and functionality are and will remain the exclusive property of Qina and its licensors. The App is protected by copyright, trademark, and other laws.

User-Generated Content

When you submit feedback, suggestions, or other content through the App, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and distribute such content for the purpose of improving our services.

Character and Story Content

All character designs, story content, dialogue, and narrative elements are proprietary to Qina. You may not reproduce, distribute, or create derivative works based on this content without our express written permission.

Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices.

Data Collection: We may collect certain information about your use of the App, including usage patterns, device information, and feedback you provide. This information is used to improve our services and is handled in accordance with our Privacy Policy.

App Availability and Updates

Service Availability

We strive to provide continuous service, but we do not guarantee that the App will be available at all times. We may experience downtime due to maintenance, updates, or technical issues.

Updates and Modifications

We reserve the right to modify, update, or discontinue the App (or any part thereof) temporarily or permanently with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App.

Required Updates

Some updates may be required for the App to function properly. We recommend keeping your App updated to the latest version.

In-App Purchases and Subscriptions

Currently, Qina is a free-to-use application. If we introduce in-app purchases or subscription services in the future, the following terms will apply:

All purchases are final and non-refundable unless required by law
Prices may change at any time with notice
You are responsible for any applicable taxes
Subscription services will auto-renew unless cancelled

Limitation of Liability

Disclaimer: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

In no event shall Qina, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the App.

Indemnification

You agree to defend, indemnify, and hold harmless Qina and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may simply discontinue using the App.

Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Qina operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms constitute the sole and entire agreement between you and Qina with respect to the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
